No problem with there being proof of a driver's ability to talk to passengers, in fact I'd agree that it should be a prerequisite. But in this business, our drivers pick up the same disabled kids, from the same homes, day in day out, week in week out, and year in year out. This is a term of our contract because special needs kids require continuity of staff due to their vulnerable nature. We are only regulated under mini cab rules because TfL can't be bothered to imagine a regulatory regime that is more suited to disabled transport. It's never been a problem before.
